An Adamawa High Court sitting in Yola, has sentenced to death two drug Hawkers having found them guilty of committing culpable homicide.
The court pesided over by Hon. Justice Kyanson Lwassam, sentenced Habu Badaru, 27 and Auwal Lawan, 26 to death for “criminal conspiracy, robbery and culpable homicide”.
The convicts Habu Badaru of Askira Uba in Borno State and his accomplice,Auwal Lawan of Uba Hildi in Adamawa State were convicted after they were tried and found guilty of the offences.
In his judgement, the presiding judge said,” The sentence of the court upon you is to be hanged by the neck or by lethal injection until you are dead. May the Lord have mercy upon you”.
The convicts according to FIR had on 4th April,2022,conspired and robbed a tricycle operator, Algoni Muhammed, after forcefully injecting him with pentazocine injection at Uba Hildi in Hong Local Government Area which led to his death.
The prosecution explained that the convicts later made away with the deceased’s tricycle after killing him.
The convicts gruesomely murdered their victim, broke his neck and subsequently dumped his corpse in a river in Uba Hildi, Hong LGA, and stole his tricycle in order to sell it to raise the sum of N80,000 to N100,000 for Badaru to settle a debt for which he was being pressurized to settle.
According to the report”on that fateful day(4th April,2022), Habu and Lawan conspired and boarded the deceased’s tricycle to the house of the former, and on arrival, they held their victim and injected him with pentazocine before strangling him by breaking his neck”.
After killing him and dumping his remains in a river, Habu rode the tricycle to Mubi town in search for buyers,but people refused to buy as the sellers could not produce the particulars of the tricycle.
After the fruitless attempt to dispose off the tricycle,Habu returned to Mararaba Mubi and packed the tricycle in private residence.
The following day he took the tricycle to the town again insearch for prospective buyers but to no avail then he decided to call somebody who deals in tricycle from Uba, to come and buy it.
On his arrival in Mubi, the business man asked Habu, how he got the tricycle since he hawk drugs and never been in tricycle business? But Habu could not offer any convincing answer.
The business man,then secretly called the Chairman of Tricycle Sellers and informed him about the development. The Chairman alerted the police who stormed the area and apprehended the Habu and on interrogation,he mentioned Lawan as his accomplice.
